SWEEPSTAKES PERIOD: The Dancing with the Stars Season 15 Finale Sweepstakes (the "Sweepstakes") begins on or about 9/26/12 at 12:01 a.m. Eastern Time ("ET") and ends on 11/12/12 at 11:59 p.m. ET (the "Sweepstakes Period"). By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects.
ELIGIBILITY: Only legal U.S. residents who are eighteen (18) years of age or older at the time of entry and reside in the WTNH-TV Designated Market Area ("DMA") as determined by Nielsen Media Research Services are eligible to enter. This area covers the following counties in the Hartford area: Hartford, Middlesex, New Haven, New London, Tolland, Windham and Fairfield. Employees of Sponsor, Administrator, American Broadcasting Companies, Inc., BBC Worldwide Americas, Inc., and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies as well as each of their respective successors, representatives and assigns, and each of their respective officers, directors and employees, and the immediate family members, and/or those living in the same household of each, are ineligible to enter the Sweepstakes or win a prize. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren.
SWEEPSTAKES ENTRY: Visit the web site www.abcaffiliatesweepstakes.com/Hartford (the "Website") and follow the instructions to enter. You will be asked to provide your name, complete mailing address (with zip code), e-mail address, date of birth, and daytime telephone number. You may be asked to consent to receive promotional e-mails and reminder e-mails. Consenting to receive promotional or reminder e-mails is optional and does not have to be agreed upon in order to be eligible to participate in the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of ABC.com and you may opt out of receiving these e-mails at any time. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of such entry. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. Personal information collected in connection with this Sweepstakes will be used in accordance with ABC.com’s privacy policy, available at http://corporate.disney.go.com/corporate/pp_abc.html.
All entries must be received by the end of the Sweepstakes Period in order to participate. The Website’s database clock will be the official time keeper for online entries in this Sweepstakes. Released Parties (as defined below) shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes. The Released Parties (as defined below) assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.
Limit one (1) entry per person, regardless of the number of email addresses or accounts a person may have. Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all entries by such person. Entries must be manually key-stroked; use of automated entry devices or programs is prohibited. In the event of a dispute over who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail account identified on the online entry form. The authorized account holder is deemed to be the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries become the property of Sponsor and will not be returned.
WINNER SELECTION AND NOTIFICATION: At the end of the Sweepstakes Period, the prize winner will be randomly selected from all eligible entries received during the Sweepstakes Period. The potential prize winner will be notified using contact information provided at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner will be selected. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of a prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. The odds of winning a prize depend on the number of eligible entries received.
PRIZES/APPROXIMATE RETAIL VALUES: One (1) Grand Prize: Two (2) admission tickets to the live taping of the final "Dancing with the Stars" performance show ("Show"), which is currently scheduled to take place on November 26, 2012 in or around Los Angeles, California. Date and location of Show taping are subject to change. The Grand Prize also includes: two (2) nights’ hotel accommodation (one room, double occupancy) at a hotel in the Los Angeles area hotel to be determined by Sponsor; roundtrip ground transportation between the hotel and the Show taping; round-trip, coach-class air transportation for the winner and one (1) guest from Hartford to Los Angeles, CA; one (1) Barbie® Collector Dancing with the Stars Barbie® doll; and one (1) autographed “Dancing with the Stars” poster (specific autographs to be determined solely by Sponsor). There is no retail value associated with the poster and there is no retail value associated with the live taping portion of the Grand Prize.
Accommodations and travel are for two individuals sharing one accommodation. Trip is non-transferable and cannot be extended beyond the date set forth above. Grand Prize winner is solely responsible for all other expenses not specified herein, including but not limited to travel from winner’s residence to and from the Hartford airport, meals, beverages, tips, taxes and hotel incidentals.
The total approximate retail value (“ARV”) of the Grand Prize package is approximately $3,000.
The winner’s travel companion must be ten (10) years of age or older, and if the travel companion is a minor, the winner must be such companion's parent or legal guardian. Winner and his or her guest must travel together on the same itinerary and possess all required travel documents, including visas and valid passports, if and as applicable. Air transportation tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. ARV for travel prizes may vary depending upon points of departure and destination and fare fluctuations. Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the prize ARV in these Official Rules.
Grand Prize winner and/or winner’s guest must follow all instructions of Sponsor relative to the Grand Prize trip. Should Grand Prize winner and/or guest fail to adhere to any such instructions or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior (as determined by Sponsor in its sole discretion), Sponsor reserves the right, without further notice or warning, to terminate the trip or other applicable experience early, in whole or in part, and send Grand Prize winner and/or winner’s travel guest home and/or take other actions as Sponsor deems appropriate in its sole discretion without any liability or other obligation to winner or guest. Winner and guest must comply with the Show’s rules and regulations at all times. Failure to do so may result in forfeiture of the prize. Show taping is subject to, and Sponsor is not responsible for, changes to production schedule, production exigencies or delays, postponements or cancellation of the Show. If winner is unable to travel during the dates designated by Sponsor, the prize will be forfeited in its entirety and Sponsor will have no further obligations to the Winner. In the event the prize winner is able to participate in the trip during the dates designated by Sponsor but the Show taping does not or cannot take place as scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, location changes, an event of force majeure, or for any other reason, then the Sponsor reserves the right to award the remainder of the prize with no further obligation to the winner. Without limiting the foregoing, no cash alternative or prize substitutions will be allowed, except Sponsor reserves the right to substitute prize(s) of comparable value if a prize listed or any portion thereof is unavailable for any reason.
FIRST PRIZE WINNERS (3 winners): Each First Prize winner will receive one (1) autographed “Dancing with the Stars” poster (specific autographs to be determined solely by Sponsor). ARV of each First Prize is $5.00.
ARV of All Prizes is $3,015.00.
CONDITIONS & LIMITATION OF LIABILITY: Prize winners shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize (including, without limitation, travel expenses not included as part of the Grand Prize, meals, beverages, tips, taxes and hotel incidentals). Any potential prize winner may be required to execute an Affidavit of Eligibility/Liability Release, and (to the extent permitted by law) a Publicity Release. The travel companion of travel prize winner may also be required to execute applicable documents prior to ticketing of the travel prize. If winner fails or refuses to sign and return such documents within seventy-two (72) hours days of prize notification (or a shorter time if required by exigencies), winner may be disqualified and an alternate winner may be selected. Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished by third parties in connection with the Sweepstakes. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE RELEASED PARTIES (AS DEFINED BELOW) HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
Acceptance of a prize constitutes prize winner’s permission for Sponsor and its assigns to use prize winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Sponsor and its assigns are not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation. Entrants agree that Sponsor, Administrator, American Broadcasting Companies, Inc., BBC Worldwide Americas, Inc., and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies as well as each of their respective successors, representatives and assigns, and each of their respective officers, directors and employees (collectively, the “Released Parties”): (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, including any travel related thereto, or from entrant’s acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.
Released Parties assume no responsibility for any damage to an entrant’s or any other person’s computer system or wireless phone which is occasioned by accessing the Website or otherwise participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Released Parties are not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right, in its sole discretion, to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. In such event, Sponsor shall conduct the Sweepstakes and (if possible) select winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
DISPUTES; ARBITRATION/CHOICE OF LAW: : Except where prohibited, and subject to the release and waiver of claims provision herein, entrants and Sponsor agree that: (1) any and all disputes, claims, and causes of action arising out of or related to the Sweepstakes, or any prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective; (2) by participating in the Sweepstakes, entrants waive any right to seek or obtain injunctive or other equitable relief; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering Sweepstakes, but in no event attorneys’ fees; and (4) under no circumstances will an entrant be permitted to obtain awards for and each entrant, by participating in the Sweepstakes, hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Connecticut, without regard for conflicts of law doctrine of Connecticut or any other jurisdiction, and all proceedings shall take place in the City of Hartford, County of Hartford.
WINNER’S LIST: For the name of the winners, mail a self-addressed, stamped envelope to: Dancing With The Stars Season 15 Finale Sweepstakes Hartford Winners, c/o LeadDog Marketing Group, 159 W. 25th Street, 2nd Floor, New York, NY 10001. All such requests must be received within four (4) weeks after the end of the Sweepstakes Period.
